On 23 June, the CESOP expert group at the EU Commission published the first answers to the operators' FAQs , which were also discussed at the ABI meeting on 14 July.
The FAQ will remain in draft until the end of the year so we expect changes and further clarifications.
Below we report some points that emerged :
clarifications on the countries involved and excluded
clarifications on excluded relationships and operations:
Cryptocurrency payments are excluded
escrow accounts or accounts linked to financing are excluded
information has been provided on the personal details and the procedure for identifying the beneficiary in the event that the beneficiary is not a customer of the PSP
it was specified that the register should be kept only for communicated payments
guidance has been provided on the treatment of certain types of payments such as refunds, technical refunds and partial payments
notes on the payer's data in the register have been provided - as is known, the payer is not reported except with his attributes that allowed his location but the PSP is given the option to keep the payer's data in the register
NEXT STEPS
We are carrying out checks on the types of relationships and operations within the reporting perimeter
The Council of Ministers has given the first approval to the decree that implements the CESOP directive that will regulate the sanctions, we expect the publication of the Legislative Decree by the end of July or in August
Consequently, the Revenue Agency will publish the Provision that will specify the rules for the transmission of the report
